Legal regulation of AI in Ukraine

Yesterday, the Ministry of Digital Transformation published a White Paper on AI regulation in Ukraine. And it just so happened that our Oksana Zadniprovska was talking about AI with Alessandro di Matia from Privacy Rules. There's even a video of it. It's in English, but that's not a problem, right?

And for those who prefer text over videos, here is a brief overview of the White Paper:

– Last year, the Ministry of Digital Transformation published a roadmap for AI regulation in Ukraine. Even then, they said that they would not rush to pass the law, but would learn from others’ mistakes and listen to businesses. This is a kind of “bottom-up” approach.

  • The White Paper only confirmed this opinion and provided interesting statistics: 45% of respondents believe that Ukraine needs a law on AI.
  • The Ministry of Digital Transformation does not consider it appropriate to regulate AI in the military sphere – this is not in the interests of our national security.
  • Instead, in Ukraine, AI should primarily be regulated by business and sectoral recommendations (such recommendations already exist for the media, as provided by the Digital Security Laboratory (Digilab)).
  • It is also worth following existing laws, such as those on personal data protection. Specific issues, such as those related to intellectual property, should be regulated by IP legislation, not some AI law.
  • At the next stage of preparing the regulation, the Ministry of Digital Transformation will create a portal where organizations working with AI will be able to go through the methodology for assessing AI risks to human rights, join the code of conduct, join the regulatory sandbox, or even take a training course on AI. There are other tools offered by the Ministry of Digital Transformation.
  • And in a year or two, it will be possible to start thinking about drafting a law on AI, keeping an eye on what is being done with the implementation of the AI act in the EU and other countries.

A healthy approach, right? We like it. Anyone who disagrees has three months to comment on the Ministry of Digital Transformation’s approach — the white paper has been open for discussion since yesterday.
